Terms & Conditions

تم إعداد برنامج الولاء ("البرنامج") والترويج له من قبل شركة العين للأغذية والمشروبات ش م ع - إحدى شركات مجموعة أغذية ش م ع ("مياه العين" أو "الشركة").

The Loyalty Program (“Program”) is organized and promoted by Al Ain Food & Beverages PJSC - an Agthia Group PJSC Company (“Al Ain Water” or “Company”).

يشكل هذا النص العقد الذي يحكم العلاقة بين شركة مياه العين وبينك ("المستهلك") بخصوص التعاقد على تفعيل البرنامج. يخضع المستهلك للشروط والأحكام الواردة في هذا المستند.

This text is the contract that governs the relationship between Al Ain Water and you (the “Consumer”) in contracting the activation of the Program. The Consumer shall be subject to the Terms and Conditions laid herein.

The Terms and Conditions (the “T&Cs”) of the Program are posted on Al Ain Water website [https://shop.alainwater.com/pages/loyalty-program-t-c].

تحتفظ شركة مياه العين بحقها في تعديل ومراجعة الشروط والأحكام في أي وقت. يتحمل المستهلك مسؤولية المراجعة المنتظمة للشروط والأحكام.

Al Ain Water reserves the right to revise the T&Cs at any time and. You are responsible for regular review of the T&Cs.

يجوز تعديل هذه الشروط والأحكام من وقت لآخر على الموقع الالكتروني للشركة دون إخطارك بذلك. وبالتالي يجب عليك مراجعة هذه الشروط والأحكام بشكل منتظم للبحث عن أي تعديلات من هذا النوع.

These T&Cs may be modified from time to time on the Website without notice to you and you should therefore regularly review these T&Cs for any such modifications.

المادة 1: النطاق

Article 1: Scope

أ)

يطبق هذا البرنامج على جميع مستخدمي تطبيق مياه العين ("التطبيق")

This program is applicable to all Al Ain Water application (“App”) users

ب)

يمكن تحميل التطبيق من متجر ابل ستور (Apple Store) وبلي ستور (Play Store).

The App is available on Apple Store & Play Store

b)

ج)

سيتم تسجيل جميع مستخدمي التطبيق في البرنامج عند التسجيل أو عند تسجيل الدخول.

All App users will enroll in the Program upon registration or sign in

د)

تمنح كل زيادة رصيد للمحفظة في التطبيق نقاط تعرف باسم قطرات ("قطرات"). تعادل كل قطرة 10% من كل زيادة رصيد للمحفظة أي أن قطرة واحدة تساوي 10 دراهم إماراتية مقابل زيادة رصيد المحفظة في التطبيق.

Every wallet top up in the App will provide points known as Drops (“Drops”). One Drop is equivalent to 10% of every wallet top up, i.e. 1 Drop is equal to 10 AED wallet top up in the App

تمنح فقط عمليات زيادة رصيد المحفظة من التطبيق القطرات إلى حساب المستهلك.

Only wallet top ups from the App will provide Drops to the Consumers account

يجب عليك جمع القطرات للانتقال إلى المستويات الأعلى في البرنامج. وسيتم توفير 3 مستويات في هذا البرنامج.

Accumulate Drops to move up the tiers in the Program. A total of 3 tiers will be provided in this program.

يمنح كل مستوى للعملاء مكافآت من شركاء تجاريين مختلفين ("الشركاء) بناءً على الاتفاقية الموقعة بين الشركة والشركاء.

Every tier will provide customers with rewards from different merchant partners (“Partners) based on the agreement between the Company & the Partners

ح)

تم تحديد المستوى الأزرق من 0 إلى 30 قطرة، والمستوى الأخضر من 31 إلى 80 قطرة والمستوى البلاتيني فوق 80 قطرة.

The blue tier is defined as 0 to 30 Drops, green tier as 31 to 80 Drops and platinum tier is above 80 Drops

عند تسجيل المستهلك أو تسجيل الدخول إلى التطبيق، سيسجل بشكل تلقائي في المستوى الأزرق بدون أي قطرات. وعندما يكمل المستهلك زيادة رصيد المحفظة، سيبدأ تراكم القطرات.

يمكن استبدال هذه القطرات من شركاء مختلفين على النحو المتوفر في التطبيق.

Once the consumer registers or signs into the app, he will automatically enroll in the blue tier with 0 Drops. As the consumer completes their wallet top, they will accumulate Drops.

These Drops can be burnt against different Partners as available in the App.

The accumulated Drops will dictate the Consumer’s tier status

البرنامج ساري المفعول في الإمارات العربية المتحدة ("الإمارات العربية المتحدة") للمقيمين في الإمارات العربية المتحدة الذين يستخدمون التطبيق.

The Program is valid in United Arab Emirates (“UAE”) for United Arab Emirates residents who are using the App

المادة 2: شروط المشاركة

Article 2: Participation Conditions

أ)

إذا كان يملك المستهلك العدد المطلوب من القطرات، يجوز له استبدالها مقابل شركاء معنيين في المستوى.

If the Consumer has the required number of Drops, it can be redeemed against relevant Partners in the tier

في صفحة "My Loyalty Drops" على التطبيق، يجوز للمستهلك عرض مكافآت الشريك وتحديد زر "استرداد" للاستفادة من العرض. عند استرداد القطرات، تنخفض قطرات المستهلك حسب العدد المطلوب من القطرات.

On the ‘My Loyalty Drops’ page in the App, the Consumer can view Partner rewards & select the ‘Redeem’ button to avail the offer. On redeeming Drops, the Consumer’s Drops will reduce by the required number of Drops.

بعد الاسترداد، ترسل رسالة نصية قصيرة وبريد إلكتروني إلى المستهلك على رقم هاتفه المحمول المسجل وعنوان بريده الإلكتروني على التوالي مع رمز قسيمة واحد لاستخدامه.

On redemption, a SMS & email will be sent to Consumer on their registered mobile number & email address respectively with a unique coupon code that can be used

يمكن استخدام القسائم من كل شريك مرتين في الشهر، ولكن سيتم إصدار رمز قسيمة واحد لكل عملية استرداد.

Coupons from each Partner can be used twice in a month however there will be a unique coupon code issued on every redemption

بعد إلغاء القفل، يكون لكل رمز قسيمة فترة صلاحية من 3 أشهر.

Once unlocked, every coupon code will have a validity of 3 months

بموجب شروط وأحكام القسيمة الواردة في التطبيق، سيتم تحديد ما يلي:

Under the coupon T&Cs in the App the following will be mentioned

1-       موقع الشريك لاستخدام القسيمة والاستفادة من العرض المحدد.

1.         Partner website to use the       coupon & avail the             specific offer

2-       الحد الأقصى للخصم الذي           يمكن الاستفادة منه في           العروض ذات الحد الأقصى           للخصم.

2.         The maximum discount             that can be availed, for             offers with a discount cap

3-       أي استثناءات لرمز القسيمة على الموقع الالكتروني           للشركاء.

3.         Any exclusions for the             coupon code on the             Partners website.

4-

لا يمكن استخدام القسيمة أو دمجها مع أي عرض آخر.

The coupon cannot be used or combined with any other offer.

يجب حجز جميع الخدمات بشكل مباشر مع الشريك للاستفادة من العرض.

All services need to be booked directly with the Partner to avail the offer.

لا تتحمل شركة مياه العين مسؤولية أي مشكلة أثناء الحجز/ إتمام الخدمة.

Al Ain Water is not responsible for any occurrence during the booking / completion of the service.

تحتفظ شركة مياه العين بالحق لتغيير / تعديل / سحب هذا العرض في أي وقت.

Al Ain Water reserves the right to change/amend/withdraw this offer at any time.

يجوز تطبيق الشروط والأحكام الاضافية للشريك والافصاح عنها في التطبيق بموجب شروط وأحكام القسيمة.

Additional Partner T&Cs may apply & will be disclosed in the App under the coupon T&Cs

د)

تكون جميع عروض الشركاء والقطرات المطلوبة للاستفادة من العروض واضحة في تطبيق شركة مياه العين في صفحة " My Loyalty Drops ".

All Partner offers & required Drops to avail the offers are visible in the Al Ain app, under the ‘My Loyalty Drops’ page

إذا لم يملك العميل العدد المطلوب من القطرات، سيتم إغلاق مكافأة الشريك التاجر حتى يتم جمع العدد المطلوب من القطرات.

If the Customer does not have the required number of Drops then the Merchant Partner reward will be locked until the required number of Drops are accumulated.

رموز القسائم غير قابلة للتحويل ولا يمكن استبدالها بأي جوائز أخرى أو أي مقابل آخر.

Coupon codes are non-transferable and are not redeemable for other prizes or other consideration.

ز)

رمز القسيمة غير قابل للدفع أو الاسترداد من حيث الإشعار الدائن أو أي بند بغض النظر عن طبيعته وقيمته.

The Coupon code is not payable / redeemable in terms of credit note / any item regardless of nature and value.

g)

ح)

يتم منح رمز القسيمة "كما هو". ولا تقدم الشركة أي كفالة أو ضمان أو تعهد من أي نوع كان سواء صريح أو ضمني حسب الواقع أو القانون فيما يتعلق بأي جائزة أو استخدامها أو قيمتها أو التمتع بها.

The Coupon code will be awarded “as is” and the Company makes no warranty, guarantee or representation of any kind, expressed or implied, in fact or in law, concerning any prize, its use, value or enjoyment.

لا تتحمل شركة مياه العين مسؤولية أي موضوع يتعلق برمز القسيمة بعد استلامه وأثناء استخدامه.

Al Ain Water shall not be responsible for any matter related to the Coupon code after receiving and during the use of it.

l)

المادة 6: حقوق استخدام الملكية الفكرية وإخلاء المسؤولية القانونية

Article 6: Intellectual Property Usage Rights & Legal Disclaimers

أ)

يمنح المستهلك بموجب هذا الشركة بدون أي رسوم الحق والصلاحية غير المشروطة والدائمة لنشر وبث في أي مكان في العالم لأغراض التحرير والإعلان والترويج والتسويق و/أو أي من الأغراض الأخرى وفي أي وسائل إعلامية اسمه/ اسمها أو صورة و/أو صورة فوتوغرافية مماثلة أو لقطات فيديو أو تسجيل صوتي تم التقاطه له/لها أثناء العروض الترويجية المعنية باستثناء الحالات التي يحظرها القانون.

The Consumer hereby grants to the Company, at no cost, the unconditional, perpetual right and authority to publish and broadcast anywhere in the world, for editorial, advertising, promotional, marketing and/or other purposes and in any media, his/her name, image, likeness and/or photograph, video footage or audio record taken of him/her, taken during and for the purpose of the relevant promotions, except where prohibited by law.

تشكل المشاركة في البرنامج تصريح واضح من المستهلك للشركة والشركات التابعة لها لاستخدام اسمه أو اسمها و/أو معلوماته/ معلوماتها الشخصية و/أو أي تصاريح يقدمها/تقدمها بخصوص البرنامج والأغراض الإعلانية فقط دون أي إشعار أو تعويض إضافي باستثناء الحالات التي يحظرها القانون.

Participation in the Program constitutes the Consumer' permission for the Company and its affiliated companies to use his/her name(s), personal information and/or any statements made by him/her regarding the Program and advertising purposes only without notice or additional compensation, except where prohibited by law.

لا تتحمل الشركة مسؤولية أي خسارة أو ضرر أو إصابة أو خسارة أرباح أو أضرار غير مباشرة أو مباشرة أو أضرار تبعية أو عرضية أو أضرار عقابية أو نموذجية أو أحكام أو تكلفة أو مصاريف من أي نوع كان بما في ذلك على سبيل المثال لا الحصر أضرار الممتلكات والاصابات الشخصية و/أو الوفاة التي قد تحدث فيما يتعلق بالمشاركة في البرنامج أو حيازة و/أو قبول و/أو استخدام أو إساءة استخدام الجائزة.

The Company shall not be held liable for any loss, damage, injury, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, cost or expense whatsoever, including without limitation to, property damage, personal injury and/or death which may occur in connection with the participation in the Program, or possession, acceptance and/or use or misuse of the prize.

المادة 7: الترويج

Article 7: Promotion

أ)

إذا كان هذا البرنامج لأي سبب من الأسباب غير قابل للتنفيذ كما هو مخطط له بسبب على سبيل المثال لا الحصر الإصابة بأي فيروس كمبيوتر أو أخطاء أو تلاعب أو تدخل غير مصرح به أو احتيال أو عطل تقني أو القضاء والقدر أو الحرب (سواء تم الإعلان عنها أو لا) أو انقلاب سياسي أو تمرد أو نزاع عمالي أو حريق أو وباء أو عاصفة أو فيضان أو إعصار أو انفجار أو تشريع قانوني أو توجيه حكومي أو أمر أو لائحة أو أي قانون أو لائحة تتمتع بقوة القانون أو لأي سبب آخر خارج عن السيطرة المعقولة للشركة والتي تعطل أو تؤثر على أمن أو عدالة أو نزاهة الإدارة أو حسن سير تنفيذ هذا البرنامج، تحتفظ الشركة إلى أقصى حد يسمح به القانون بالحق للقيام وفق تقديرها المطلق بإلغاء هذا البرنامج أو إنهائه أو تعديله أو تعليقه واستبعاد أي مشارك يتلاعب بالبرنامج و/أو بعملية الدخول. إلى أقصى حد يسمح به القانون، لا تتحمل الشركة مسؤولية أي مشاكل أو عطل فني في أي شبكة أو خطوط هاتفية أو أنظمة كمبيوتر على الإنترنت أو خوادم أو مزودي البرامج و/أو معدات كمبيوتر وتعطل حساب أي بريد إلكتروني أو أي جمع لها.

If for any reason this Program is not capable of being carried on as planned, due to without limitation infection by any computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, act of God, war (whether or not declared), political coup or insurrection, rebellion, labor dispute, fire, epidemic, storm, flood, typhoon, explosion, legal enactment, government directive, order or regulation, any law or regulation having force of law or any other reason or cause beyond the control of the Company, which corrupts or affects the administration security, fairness or integrity or proper conduct of this Program, the Company, to the fullest extent permitted by law, reserves the right in its sole discretion to cancel, terminate, modify or suspend this Program and to disqualify any Participant who tampers with the Program and/or the entry process. To the fullest extent permitted by law, the Company is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer software and/or equipment, failure of any e-mail account or any combination thereof.

يعتبر قرار (قرارات) الشركة فيما يتعلق بجميع الأمور المرتبطة بالبرنامج نهائي وغير قابل للاستئناف.

The decision(s) of the Company in connection with all matters relating to the Program shall be final and non-appealable.

ج)

في حالة وجود أي نزاع أو خلاف فيما يتعلق أو يرتبط بالعرض، سيكون قرار الشركة نهائي وملزم لجميع المعنيين.

In case of any dispute or difference in respect of or in connection with the offer herein, the decision of the Company shall be final and binding on all concerned.

د)

يخضع هذا البرنامج لقوانين دولة الإمارات العربية المتحدة. وسيتم حل أي نزاع من قبل المحاكم في أبوظبي، الإمارات العربية المتحدة.

The laws of the United Arab Emirates shall govern this Program. Any dispute shall be adjudicated upon by the Courts in Abu Dhabi, United Arab Emirates.
